Terms & Conditions

1. General

These terms and conditions apply to all services provided by Ember Studios. By confirming a booking or accepting a quotation, the client agrees to these terms.

2. Pricing

All prices listed are exclusive of VAT and based on an estimate of the required time and scope of work.
If the scope, duration, or deliverables change, Ember Studios reserves the right to adjust the pricing accordingly.

3. Payment Terms

Invoices are payable within 10 days of the invoice date.

In case of late payment, interest of 12% per year and a fixed compensation of 10% of the outstanding amount (minimum €250) will be applied automatically and without prior notice.

4. Delivery

Final images are delivered after full payment has been received.
Standard delivery time is within 14 working days after the shoot, unless otherwise agreed.

5. Revisions & Additional Work

The agreed price includes one round of revisions.
Additional edits, requests, or extra work will be charged at a rate of €80/hour.

6. Usage Rights

The client receives a non-exclusive license to use the images for organic online use (such as website and social media).

Any use for advertising, paid campaigns, print, or other commercial purposes requires a separate agreement and may involve additional licensing fees.

7. Duration of Use

Unless otherwise agreed, usage rights are granted for a period of 12 months.

8. Copyright & Ownership

All images remain the intellectual property of Ember Studios.
Usage rights are granted only after full payment has been received.

Ember Studios reserves the right to use the images for portfolio and promotional purposes unless otherwise agreed in writing.

9. Creative Direction

Ember Studios retains full artistic and creative control over the execution, selection, and editing of the images.

10. Cancellation

In case of cancellation less than 48 hours before the scheduled shoot, Ember Studios reserves the right to charge a cancellation fee.

11. Complaints

Any complaints must be submitted in writing within 7 days of delivery or invoice date.

12. Liability

Ember Studios cannot be held liable for indirect damages, loss of profit, or third-party claims resulting from the use of the images.

13. Jurisdiction

All agreements are governed by Belgian law.
Any disputes fall under the jurisdiction of the courts of Antwerp.
